These terms cover your use of the Bytes After Dark website and the apps and tools we provide. By using them, you agree to what's below. If you don't agree, please don't use them.
The tools
Bytes After Dark provides small creative tools — some that run in your browser (such as parametri, cophony, and mutnt) and some you download and run on your own computer (such as greybox). Some tools are free; others may be offered for purchase, in which case any additional purchase terms will be presented with that tool.
Your license to use them
We grant you a personal, non-exclusive, non-transferable license to use the tools for their intended purpose, including commercial work you create with them. You may not resell, redistribute, or rent the tools themselves, or attempt to pass them off as your own.
Your work is yours
Anything you create with our tools belongs to you. We claim no ownership of your projects, files, or exports, and — because the tools keep your work on your own device — we don't have access to it. See our Privacy Policy for details.
Acceptable use
Please don't use the tools to break the law, to infringe someone else's rights, or to disrupt, attack, or reverse-engineer our services in bad faith. We may restrict access if the tools are being misused in a way that harms others or the service.
Availability and changes
The tools are offered as an ongoing project. We may update, change, or discontinue any tool or feature at any time, and we can't guarantee uninterrupted availability. Browser apps depend on services like our host; downloadable apps will keep working on your device, but may not receive further updates.
No warranty
The tools are provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't warrant that they will be error-free, secure, or fit for a particular purpose. You use them at your own risk, and you are responsible for keeping your own backups of your work.
Limitation of liability
To the fullest extent permitted by law, Bytes After Dark will not be liable for any indirect, incidental, or consequential damages, or for any loss of data or work, arising from your use of — or inability to use — the tools.
Third-party services
The website and some tools rely on third parties (for example, Cloudflare for hosting and Google Fonts for typefaces). Their own terms and privacy practices apply to the parts they provide.
Governing law
These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules. Any dispute arising from these terms or your use of the tools will be brought exclusively in the state or federal courts located in Michigan.
Changes to these terms
We may update these terms from time to time. When we do, we'll revise the "last updated" date above. Continuing to use the tools after a change means you accept the updated terms.
